Business Visitors

NAFTA increased the number of Canadian, Mexican and United States citizens able to obtain temporary entry visas. NAFTA also increased the types of permissible activities of business visitors. For example, temporary entry visas were available for purposes of research and design, purchasing, production, marketing, sales, distribution and after-sales service. Such visas could also be had by persons providing general services, including credentialed professionals, managers, supervisors, financial services personnel, public relations officers, advertising staff, tourist leaders, tour bus operator and translators. One of the requirements for temporary business visitor visas was non-remuneration in the country of entry. For this reason, there were no pre-entry employment validation or labor certification screening procedures in connection with NAFTA business visitor visas (B–1 visas in the United States).

Numerical limits on the number of NAFTA business visitors were banned. However, entry could be barred for reasons of public safety or national security. Normally, business visitors needed only prove citizenship, document their scheduled NAFTA business activities, and offer evidence that they are not seeking to enter the local labor market. Oral declaration at the border as to source of remuneration, principal place of business, and predominant outside accrual of profits were usually sufficient to meet these criteria.

The administration of business visitor visas differed among the member states. Canadian business visitors could cross United States borders without advance visas. United States business visitors to Canada could do likewise. Mexicans, however, must obtain advance business visitor visa approvals to enter Canada and the United States. Similarly, Canadian and United States business visitors must get visas in advance of going to Mexico.
